Miner drags IGP, EFCC to court, demands N1billion damages

      A Jos based Miner, Alhaji Abdullahi Adamu has sued the Inspector General of Police (IGP), Solomon Arase, the Economic and Financial Crimes Commission, EFCC and a Chinese man, before a Jos Federal High Court for an alleged unlawful arrest, detention and violation of his fundamental human rights.
The Miner also known as Dan China is demanding N1billion as damages through his Counsel, Gyang Zi.
He prayed for an order for his immediate release by the Police and the EFCC, whom he accused of arresting and detaining him for 10 days now for no just cause other than serving the interest of the Chinese national.


      Adamu alleged that the Police and the EFCC had been threatening him to either withdraw the case he instituted against the Chinese national at the Jos Federal High Court in 2013 or rot in detention.
In an originating motion, made available to journalists in Jos on Wednesday, Adamu asked the court to issue an order declaring his arrest and detention for 10 without being taken to court by the respondents as illegal, unlawful and a violation of his fundamental human rights.
He also prayed for an order to restrain the respondents or their agents or representatives from threatening, intimidating, arresting, detaining and or interfering with his private family life and subjecting him to psychological trauma.
It reads, “An order directing the respondents to pay the sum of N1, 000, 000.00 (One billion Naira) only as damages against the respondents for subjecting the applicant to psychological trauma”.

       Adamu expressed surprise at the turn of events where he, being the victim of a cheat and complainant is now being looked at as the culprit with his alleged unlawful arrest and detention at the force headquarters in Abuja.
In a 26 paragraph affidavit, Adamu, accused the IGP and EFCC of violating a court order of February and November 2014, restraining any security operatives from arresting any one related to a case between the plaintiff and the Chinese national one Mr Zhai Feng Quan.
He alleged that Quan cheated him over a mining business being carried out under the company name of Solid Unit Nigeria Limited at Zurak community in Wase Local Government of Plateau running to N40 billions and had sued him before the same Jos Federal High Court.


The applicant alleged that since he instituted the case against the foreigner, he had been using security operatives to frustrate and truncate the case as “anybody that came to court to testify had been arrested and detained by the security operatives.
“At least, five witnessed who testified in court had been picked and detained by the security operatives on the request and manipulation of the Chinese national.
“The worst they could do to the case is my arrest and detention by security operatives in Abuja Force Headquarters on April 16, 2016 when they trailed me to a Hospital where I went visiting the Emir of Bashar along Solomon Lar Amusement Park, Jos, ’’ he further alleged.
He also alleged that Quan, his business partner, had resorted to“ selling the company’s property including wit trucks, pay loaders and other mining machines and equipment without any authority and has violated Solid Unit Nig Ltd standing rules in so many ways.

The applicant averred that he could not be prosecuted or tried of the same offense twice, therefore, it’s the applicant’s right to be investigated by the police and the EFCC at the same time and on the same subject matter.
Adamu urged the court to issue a declaration that the connivance of the respondents to arrest, harass and detain the applicant in the manner aforesaid “despite the pendency of suit No. FHC/J/CS/108/2013 is illegal, unlawful and a gross violation of the constitution of the Federal Republic of Nigeria 1990 (As Amended).”
