A 53-year-old man, Olawale Akinro, who allegedly obtained N3 million from one Audu Zubair on the pretext of selling a container with goods to him, on Wednesday appeared before an Apapa Magistrates’ Court, Lagos.
Akinro, who resides at Ajegunle area of Lagos, is facing a three-count charge of conspiracy, stealing and obtaining money under false pretences.
He, however, denied committing the offences.
The Prosecutor, Insp. Tony Elibeh, said that the accused committed the offences in March 2015 at Apapa Ports, Lagos.
Elibeh said that Akinro, with others now at large, obtained N3 million from the complainant with a promise to sell an auctioned container with goods to him.
“The accused and his cohorts converted the money to their own personal use and did not sell any container with goods to the complainant as promised.
“When the complainant did not get any feedback concerning the container, he decided to ask for a refund.
“Akinro, who had already spent the money, refused to pay the complainant,” he said.
The prosecutor said the offences contravened Sections 285,312 and 409 of the Criminal Law of Lagos State, 2011.
The News Agency of Nigeria (NAN) reports that Section 312 prescribes a 15-year jail term for obtaining money under false pretences while Section 409 stipulates two years imprisonment for conspiracy.
The Chief Magistrate, Mr Titus Abolarinwa, granted the accused bail in the sum of N500, 000 with two sureties in like sum and adjourned the case till March 30 for mention.
